If any provision of these terms and conditions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
3. Contract
No contract shall exist between you and New & Lingwood until New & Lingwood has sent you an email or other document confirming receipt and acceptance of the order you wish to place. After that confirmation New & Lingwood is entitled to withdraw from any contract in the case of obvious error or inaccuracy regarding the order confirmation, price, or goods.
4. Age requirements
Customers who shop on-line must be 18 years or over. When you purchase goods from New & Lingwood you will be asked to provide your name, email address, billing address, delivery address, telephone number and credit or debit card details.
5. Payment cards
New & Lingwood only accepts payment by Visa, MasterCard, Maestro, American Express, China Union Pay & Paypal.
6. Purchase of product
6.1 New & Lingwood's obligation to you is dependent upon the availability of goods, in the unlikely event that’s goods are sold out or no longer available New & Lingwood will send you notification and may offer you an alternative product or if no suitable alternative is available New & Lingwood will issue a refund for the retail price paid for the item. All alternatives offered will be of the same retail value as the original item. Items stored in your Wish list or shopping bag are not reserved and may be purchased by other customers. New & Lingwood at any time may reserve the right to place restrictions on the volume of goods ordered by one customer.
6.2 Prices shown on the website are the prices for which New & Lingwood will sell its goods at the time of display. Prices online may vary from in store from time to time. Information concerning prices and availability is subject to change without notice.
6.3 Prices will be seen in the currency of the country which you are shopping from. The price which you see on the website is the final price you will pay. If you are shopping from outside of the UK that price is calculated to include any additional charges for local duties and taxes.
6.4 New & Lingwood will make every effort to fulfil and deliver orders within the delivery time advertised at point of order. However, we cannot guarantee this and will not accept responsibility if your order is delivered outside this time which must be regarded as an estimate, and is also dependent on availability and normal processing. New & Lingwood cannot be held liable for late delivery for any reasons beyond our control.
6.5 Payment will be obtained by debiting your debit or credit card once we have verified your card details and received credit authorisation. From time to time we may need to contact you to provide further proof of identity as this is to protect both the customer and New & Lingwood from online fraud. In this instance we will need 1 form of photographic ID like a passport or driving licence as well as a utility bill for the address of the debit or credit card being used for the purchase. New & Lingwood reserve the right to cancel any online order should you not provide the adequate id if requested.
7. Delivery
7.1 New & Lingwood will arrange delivery of goods to the address given in the order and will endeavour to deliver the goods (subject to availability) within the time period selected by the customer. If New & Lingwood are not able to fulfill the order within the specified time frame the customer will be contacted to find a resolution. If no resolution can be found New & Lingwood reserve the right to cancel the order.
7.2 The price you pay for your purchase will include or advise of any additional charges, local import duties, customs and local sales taxes levied by the country the goods the are being shipped to. You will not be asked to pay any fees after you have made your purchase unless you the customer have opted to so.
7.3 At that point of delivery the goods will be deemed delivered and you will be deemed to be the owner of the goods subject only to your rights set out elsewhere in these Terms and Conditions.
7.4 New & Lingwood cannot deliver to PO Boxes or APO/FPO addresses; this service is not available through our chosen courier service.
7.5 Once you have placed your Order, we will promptly acknowledge your order by sending you an email which will contain the relevant details of your order. Please note, this does not constitute New & Lingwood’s acceptance of your order to buy the Merchandise – it only constitutes our acknowledgment of your order. New & Lingwood do not accept your order (and therefore we make no commitment to provide you with the Merchandise), and no contract for the sale of such Merchandise shall come into effect until we specifically accept your Order and notify you by email that we have dispatched the Merchandise to you ("Order Confirmation").
8. Next Day Delivery & Complimentary Alterations
We are pleased to offer complimentary alterations on eligible items to ensure the best possible fit and satisfaction. Please note that requesting these alterations may impact our ability to fulfill next-day delivery.
By opting for complimentary alterations, you acknowledge and agree to the following:
- Delay in Delivery: Orders requiring complimentary alterations may be delayed beyond the standard next-day delivery timeframe. In most cases, this will result in delivery on the following business day or later, depending on the complexity of the alterations.
- Notification: We will notify you promptly if your order cannot be shipped for next-day delivery due to alteration requirements.
- No Compensation for Alteration-Related Delays: As alterations are a complimentary service provided for your benefit, delays resulting from this process do not qualify for shipping refunds, delivery guarantees, or compensation.
- Estimated Delivery Adjustment: The estimated delivery date shown at checkout may not reflect delays due to alterations. The final delivery schedule will be communicated via email or SMS once alterations are confirmed.
If you require guaranteed next-day delivery, we recommend placing your order without alteration services.
9. Cancellation and returns
8.1 New & Lingwood operate a policy of refund or exchange. Goods purchased online can be returned at any time within 30 days of receipt for an automatic refund or exchange, the exception to this is underwear which is not returnable. Gifts purchased online between November 21st 2024 - December 24th 2024 will be eligible for return up to 28th February 2025. Any unwanted product must be returned in the original packaging with all labels and swing tags still in place including sock riders. If the product has been altered in any way we are not able to exchange or refund that product. Returns that are damaged or soiled will not be accepted and will be sent back to the customer at the cost of the customer, and a refund refused.
8.2 The responsibility of the return is with the customer until the goods are physically received by New & Lingwood. Please contact customerservices@newandlingwood.com for more information.
8.3 In the case of faulty goods New & Lingwood will use reasonable efforts to replace them, but if a replacement is not possible or if we choose to cancel, our only obligation will be to refund the full amount paid by you. This and the other terms contained in these terms and conditions are not intended to affect your statutory rights.

10. General
9.1 Colour shape and scale accuracy of the display on our website cannot be guaranteed as this depends on your computer or mobile device.
9.2 All the design, text and imagery on the website are for the copyright of New & Lingwood. The site may not be altered in any way or republished without written permission from New & Lingwood.
9.3 New & Lingwood reserves the right to withdraw its web site facility without notice.
11. Law, jurisdiction and language
The terms of use of this website and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English Law. The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to this website. All contracts shall be concluded in English.

16. V.I.P Privilege Cards
1. The discount is only applicable on full price product.
2. The discount applies to merchandise purchased at our Jermyn Street, Eton and New York stores and online at www.newandlingwood.com only. It is not valid in third party department stores.
3. The discount only applies to the individual named on the card. Proof of identification will be required at the till point to claim the price reduction.
4. Discount cannot be used in conjunction with any other discount or promotion or be applied retrospectively.
5. The discount cannot be used in conjunction with any event taking place in the Jermyn Street, Eton or New York stores including seasonal gifting.
6. This discount cannot be used on our made-to-order service.
7. New & Lingwood reserves the right to change these terms and conditions of this offer at any time.
